Those who hold membership in the Legion of Paupers are wraith's for whom their Death is unknown. it is not whether their death is unknown in the living world, but whether the Underworld, inclding the wraith, knows the cause.

Did they die from falling off the ten-storey building, or was it the gunshot wound when the leaper passed the window on the fifth floor? They bear both injuries, but which killed them and why? That is not to say Paupers all have bizarre circumstances surrounding their death; the train that pulls into a station with a dead passenger, with no apparent cause of death. The patient who goes under anesthetic and never wakes up despite the operation being a success. These a but a couple of deaths without explanation.

Membership in the Legion of Paupers

The majority of Paupers have died under circumstances that are not explained by their Deathmarks and the wraith themselves have no explanation as to why they are dead. Each Pauper's Deathmarks are unique; it is true that some similarities of Deathmarks occurs but, according to the Legion, no two are exactly the same. In all cases the cause of death is unknown to the wraith when they cross the Shroud, or their memory of their death is contradicted by the wounds upon their corpus.

Considerations

When making a character for this Legion, the Player should consider what the Wraith knows about their Death, and then the Storyteller will fill in the Mystery.
If a wraith uncovers the the Mystery of their Death, they remain in the Legion of Paupers because knowing the truth does not change that they died under the fog of Mystery.
It is also possible that the reason a wraith was assigned to this Legion was that the exact cause of their Death is under dispute - for example an Elderly mortal dies of AIDS; those who die in Old Age are Iron Legion but AIDS is a new disease and is vigorously claimed by the Skeletal Legion. To soothe a diplomatic incident it is not uncommon for the wraith to be declared a Pauper.
